These Terms and Conditions ("Terms") govern the use of Atavika AgentOS, an AI-powered automation platform operated by ATAVIKA INNOVATION PRIVATE LIMITED ("Atavika," "Company," "we," "our," or "us").

By accessing or using Atavika AgentOS, you agree to these Terms.


1. Services

Atavika AgentOS provides AI-powered communication and automation services including:

  • WhatsApp AI agents
  • AI voice calling systems
  • Website chat widgets
  • Workflow automation
  • Lead qualification
  • Customer support automation
  • Integrations and APIs

Features may change, evolve, or be discontinued at any time.


2. Eligibility

You must be legally capable of entering into binding agreements to use the platform.

Businesses are responsible for ensuring authorized access by their employees or agents.


3. Account Responsibilities

You are responsible for:

  • Maintaining account security
  • Protecting credentials
  • Activities conducted under your account
  • Configuring AI agents responsibly

You must immediately notify us of unauthorized access.


4. Acceptable Use

You agree not to use Atavika AgentOS for:

  • Illegal activities
  • Fraud or deception
  • Spam or unsolicited communications
  • Harassment or abusive behavior
  • Impersonation
  • Violating telecom or messaging laws
  • Unauthorized data collection
  • Malware or harmful activity
  • High-risk activities where failure may cause injury or legal harm

We may suspend or terminate accounts violating these Terms.


5. AI Limitations

You acknowledge that:

  • AI outputs may contain errors or inaccuracies
  • AI responses are probabilistic and not guaranteed
  • AI systems may misunderstand user input
  • Human review may be necessary

Atavika does not guarantee business outcomes, lead quality, legal compliance, or response accuracy.


6. Customer Responsibility for Compliance

Customers are solely responsible for complying with:

  • Data protection laws
  • Consumer protection laws
  • Telecom regulations
  • WhatsApp platform policies
  • Call recording laws
  • Marketing and consent laws

Customers must obtain all legally required permissions and consents.


7. Third-Party Services

Atavika AgentOS may rely on third-party providers.

We are not liable for:

  • Third-party outages
  • API limitations
  • Platform restrictions
  • Policy changes by third parties
  • Telecom carrier failures
  • WhatsApp delivery issues

8. Payments and Billing

Paid plans may require subscription fees.

Unless otherwise stated:

  • Fees are non-refundable
  • Pricing may change with notice
  • Failure to pay may result in suspension or termination

Taxes are the responsibility of the Customer unless required otherwise by law.


9. Intellectual Property

All platform software, branding, systems, workflows, and technology belong to Atavika or its licensors.

Customers retain ownership of their own business data and content.

You may not:

  • Reverse engineer the platform
  • Copy proprietary systems
  • Resell services without authorization
  • Use the platform to build competing services

10. Data and Content

Customers are responsible for all content processed through the platform.

Atavika may process Customer content solely for:

  • Providing services
  • Improving platform functionality
  • Security and abuse prevention
  • AI processing and automation

11. Service Availability

We do not guarantee uninterrupted or error-free service.

Maintenance, outages, infrastructure failures, or third-party disruptions may affect availability.


12. Limitation of Liability

To the maximum extent permitted by law:

Atavika shall not be liable for:

  • Indirect damages
  • Lost profits
  • Business interruption
  • Data loss
  • AI inaccuracies
  • Missed leads or opportunities
  • Regulatory penalties arising from Customer misuse

Total liability shall not exceed the amount paid by the Customer in the preceding 3 months.


13. Indemnification

You agree to indemnify and hold harmless Atavika from claims arising from:

  • Your use of the platform
  • Violation of laws
  • Customer data misuse
  • Illegal communications
  • Unauthorized recordings
  • Violations of third-party platform policies

14. Termination

We may suspend or terminate access at any time for:

  • Violations of these Terms
  • Abuse or misuse
  • Security risks
  • Legal compliance requirements

Customers may stop using the platform at any time.


15. Confidentiality

Both parties agree to protect confidential business and technical information shared during use of the platform.


16. Governing Law

These Terms shall be governed by the laws of India.

Jurisdiction shall lie in Bengaluru, Karnataka, India.


17. Changes to Terms

We may update these Terms periodically.

Continued use after updates constitutes acceptance of revised Terms.
